Terms of Service

Please read these Terms of Service ("Terms") carefully before using popupsurftrips.com (the "Service"), operated by Links Letters LLC DBA PopUp Surf Trips ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By creating an account, you represent and warrant that you meet this age requirement and that all information you provide is accurate and complete.

2. Description of Service

PopUp Surf Trips is a surf travel matching platform. We analyze surf forecasts and flight availability to identify trip windows that match your stated wave and travel preferences. We deliver these matches to you via our website dashboard and alert notifications.

The Service is currently provided free of charge. We reserve the right to introduce paid features or subscriptions in the future, with advance notice to registered users.

3. Surf Forecast Disclaimer — Important

Wave condition forecasts are predictions, not guarantees.

Surf conditions are inherently unpredictable. All wave heights, scores, and daily conditions displayed on the Service are derived from third-party forecast models and may be inaccurate. Actual surf conditions at any destination may differ significantly from what was predicted at the time of your match. We make no warranty, express or implied, that any forecasted conditions will occur. You assume all risk associated with travel decisions made based on information provided by the Service.

We strongly recommend consulting multiple forecasting sources (such as Surfline, Magic Seaweed, or Windguru) and local surf reports close to your travel dates before booking any trip. PopUp Surf Trips is a discovery and planning tool, not a real-time conditions service.

4. No Booking or Travel Services

PopUp Surf Trips does not sell flights, accommodation, or any travel products. We do not act as a travel agent, tour operator, or booking platform. Any flight prices or estimates shown are illustrative and sourced from third-party data; actual prices may differ. You are solely responsible for researching, booking, and paying for your own travel. We are not a party to any transaction you make with airlines, hotels, or any other travel provider.

5. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@popupsurftrips.com if you suspect any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Attempt to gain unauthorized access to any part of the Service or its underlying systems.
  • Scrape, copy, or redistribute content from the Service without our written permission.
  • Submit false or misleading information in your profile.
  • Interfere with the proper operation of the Service.

7. Intellectual Property

All content on the Service — including the PopUp Surf Trips name, logo, software, text, graphics, and data — is owned by or licensed to Links Letters LLC DBA PopUp Surf Trips and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

8. Third-Party Services and Links

The Service relies on third-party data providers for surf forecasts and flight information. We do not control these providers and are not responsible for the accuracy or availability of their data. The Service may also contain links to third-party websites. We are not responsible for the content or practices of those sites.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THIS DISCLAIMER INCLUDES, WITHOUT LIMITATION, ANY WARRANTY REGARDING THE ACCURACY OF SURF FORECASTS OR FLIGHT DATA PROVIDED THROUGH THE SERVICE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LINKS LETTERS LLC DBA POPUP SURF TRIPS AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSSES ARISING FROM TRAVEL BOOKINGS MADE IN RELIANCE ON FORECASTED SURF CONDITIONS THAT DID NOT MATERIALIZE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED $100 USD.

11. Indemnification

You agree to indemnify and hold harmless Links Letters LLC DBA PopUp Surf Trips and its members, officers, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Florida, and you consent to personal jurisdiction in those courts.

Before filing any claim, you agree to contact us at support@popupsurftrips.com and attempt to resolve the dispute informally for at least 30 days.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. You may delete your account at any time by contacting us at support@popupsurftrips.com. Sections 3, 7, 9, 10, 11, and 12 survive termination.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the Service before the changes take effect. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.

15. SMS / Text Messaging Terms

If you provide a mobile phone number and opt in (by checking the SMS consent box on your Profile page), you agree to receive recurring automated text messages (surf trip alerts) from PopUp Surf Trips at the number you provide. Consent to receive texts is not a condition of using the Service, and you may use the Service without enrolling.

  • Message frequency varies based on how often trips match your profile, but is less than 3 messages per week.
  • Message and data rates may apply, depending on your mobile carrier and plan.
  • To cancel, reply STOP to any message at any time; you will receive one confirmation and then no further texts. Reply HELP for help, or email support@popupsurftrips.com. You can also turn alerts off on your Profile page.
  • Carriers are not liable for delayed or undelivered messages, and we do not guarantee that messages will be delivered.
  • How we collect and handle the information related to these messages — including that we do not share your mobile number or opt-in data with third parties for marketing — is described in our Privacy Policy.
